Attorneys for Obama and the United States have asked for and received an additional 15 days to respond (until May 5, 2009) in the matter of Kerchner v. Obama, Obama's (US Dist. Court of NJ).

This suit charges that Obama (Soetoro) is not a natural born citizen and Congress has failed in its responsibility under the Twentieth Amendment, Section 3, which provides that Congress must fully qualify the candidate "elected" by the Electoral College Electors.

Apparently some people think none of the accusations about Obama's constitutional ineligibility could be true.

They assume that no one could possibly ascend to power illegitimately from Chicago politics. Really!?

You should really stop your misinformed jabbering about the Birth Certificate issue. Certainly it might furnish some clarifying information by showing up, no doubt, some of the man's dissembling ... but most people are not claiming he is not an American citizen (though he may very well not be - can't tell without the BC) but that has no bearing at all on his eligibility to be President.

On his own website "FightTheSmears.com" Obama has already admitted that:

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children."

This is Barack being unusually honest and telling everyone that at birth he was an Americsn (presumably) on his maternal side and a Brisish subject (on the fraternal side). the Kenya Constiturion also IDs Obama the lesser as a "Commonwealth citizen" - their term for a Brisish subject.

Being born with at best only one parent an American citizen therefore precludes any legal entitlement to become President no matter where he was born - and there's no way to change that except by trying straw men, red herrings, and gullible media types to faunch about "birth certificates" which have no meaning as far as the eligibility as a natural born citizen goes ... he's not and never can be.

Don't worry though, John McCain was also not eligible since he, too, was not a natural born citizen (per the Constiftutional meaning) since he was born of 2 US parents (one of the requirements) but not on "US soil" (the second requirement). He was born not in the Canal Zone on a militray base as some claim, but in the main hospital in the City of Colon, Panama ... and that appears on his BC. The meaningless Senate Resolution SR511 claimning McCain is a NBC is just more chicanery and duplicity on the part of the 2 main political parties - and remember, Obama was one of the sponsors of that resolution (Hoping, perhaps it would help his "little problem" to slide along unnoticed?). It has no legal effect at all.

So you see your original comment that "The latest case was brought by a Connecticut man who claims that Obama was a British subject when born (because of his father) which would make Obama ineligible to be President." is correct only in that the Wrotnowski case was brought by a CT man but it was not he who made the dual citizzenship claim but Mr. Obama (or whatever his name might be - where's that pesky BC?) himself. Obama needs to produce a photocopy of his actual birth certificate - which the State of Hawaii should have on file. This "Certificate of Live Birth" is a crappy Photoshop copy - check out the corners of the certificate border where they meet - that looks like crap!

Naturalized IS NOT natural-born, which is the crux of the issue. He has hired attorneys to keep records sealed rather than simply show his actual long-form HI birth certificate? Does not smell right to me, unless he is simply being arrogant. Some believe Hillary and W. know the deal...in fact, I expect there are some CIA/NSA types that do know the facts. Such could explain Obama's 'moderate' cabinet. I certainly do not put such past Obama or many other politicians that have sold their souls to reach that level or corruption.

Many US citizens who should know better apparently feel (not think) that the requirement to be "natural born" is a swipe against the Illegitimate-Affirmative-Action-President-Select O'Bama; it's not.

Those who "feel" Illegitimate-Affirmative-Action-President-Select is somehow being discriminated against may be unaware that being "natural born" is a Constitutional requirement, and therefore federal law.

The reason the requirement is not widely-known is because earlier presidents' birth places were common knowledge among voters.

By it's very use in the Constitution of the Untied States, the definition of the term "Natural Born Citizen" became set in stone when the Constitution was ratified. Until the Constitution is amended to say otherwise, the term "Natural Born Citizen" used in it's Constitutional sense, must mean EXACTLY what it meant when the Constitution was initially ratified.

To allow Congress, through the passage of law, to change the meaning or qualifications of being a "Natural Born Citizen" under the Constitution is to give Congress and the President the ability to amend the Constitution without going through the required amendment procedures. They can change the definition as it applies to Federal Law, but not as it applies to the Constitution.

The Supreme Court has stated as much in Eisner v. Macomber, 252 U.S. 189 (1920). Though the court was referring to the term "Income" as used in the 16th Amendment, the principle they stated remains.

"Congress by any definition it may adopt cannot conclude the matter, since it cannot by legislation alter the Constitution, from which it derives its power to legislate, and within whose limitations alone that power can be lawfully exercised."

So, what did the term "Natural Born Citizen" mean in 1789 to those who drafted the Constitution? Dave O. may well have the answer.

While I don't believe that PE Obama was born in Kenya, your statement is incorrect. At the time of PE Obama's birth, the law was that if the citizen/parent was the mother, she had to have resided in the US for 5 years beyond her 16th birthday. As his mother was 18 at the time of his birth, she doesn't meet the criterion. Therefore, if PE Obama was born in Kenya, he would have been a British subject at birth.

His mother was a US citizen, he could have been born on the moon and he still would be a natural born Citizen. Fight another battle, this won is over,you lost.

When the framers of the Constitution were writing the document they were going by the definition of "Natural Born" as written in the Laws of Nations. You will find it in Book 1 chapter 19. But here is the excerpt.

Laws of Nations;
§ 212. Citizens and natives.
The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent. We shall soon see whether, on their coming to the years of discretion, they may renounce their right, and what they owe to the society in which they were born. Clearly 2 parents who are citizens. (so easy a caveman could understand it)

Let's say for the sake of argument that BHO DOES meet all the qualifications to be POTUS. What concerns me more here is the consistent pattern of behavior, method of operation by BHO and his minions. He appears to have done an awful lot to hide his past, assocations, etc so people would not know the true man behind BHO. All or much of his college records are sealed? Sure, there's FERPA, but this is ridiculous. What is he hiding? BHO stonewalls anything that would make him look un-American (ie - socialistic). Of COURSE this type of behavior is going to arouse suspicion. He'd be far better off opening his records for public scrutiny. First I am not an Obama supporter but here are the facts and as John Adams once said, "facts are stubborn things"

First the Constitution states in Article 2, Section 1, Clause 5:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Second the Supreme court ruled in the Perkins v. ELG, 307 U.S. 325 (1939): The U.S. Supreme Court concluded that Marie Elizabeth Elg who was born in the United States of Swedish parents then naturalized in the United States, had not lost her birthright U.S. citizenship because of her removal during minority to Sweden and was entitled to all the rights and privileges of that U.S. citizenship. In this case, the U.S. Supreme Court affirmed the decree that declared Miss Elg "to be a natural born citizen of the United States."

This sets precedence that Obama is considered a natural born citizen even if his father was not a citizen. You can look up the court case number.

However, if there is REAL proof out there that Obama was born outside of the USA, only then is he ineligible for POTUS. I have to agree with Jamie Dupree on this. No one has released any real evidence that Obama was born in Kenya.

Who cares about Obama's birth certificate, we all know who Jamie voted for.

Personally I didn't think about it. I figured that Constitutional requirments were always vetted since it is a "requirement". But with that said ... has it been vetted? Why isn't his birth certificate available to the public eyes or is it?(Not just an image)
Questions that should always be answered when it comes to the President. Should have and always been done to all candidates for President! Is it not? The Constitution has a requirement. If the requirements are not checked why have the requirement in the first place. AND all of that should be in full public view shouldn't it?

In the end all documents that prove a constitutional requirement should be moved to the national archive and made available to the public eyes.

I think this whole thing would have been cleared up months ago if Obama had done a press conference and took it out and did a show and tell. His handlers just made it worse than it needed to be. Next, my real problem is that Barack was known as Barry Soerto not Barack Obama. He did apply as a foreigner to get into college...that is how he got in. I find it amazing that not a single reporter has ever tried to figure out how Obama was able to afford Columbia and Harvard. He basically lived on the streets of New York and yet went to some of the most expensive schools in the nation. And last, more importantly, he is a communist. No reporter has ever asked if Obama shared the same views as his childhood mentor, Frank M. Davis. That is by far more scary to me than a birth certificate.

You quote a person from Hawaii saying its a valid birth certificate....the only problem is, no one has seen the birth certificate, all we've seen is a certificate of living birth, which is different, and has been shown beyond a rational reasonable doubt to have been falsified.

It is amazing so many people do not understand natural born. You do not have to be born in the U.S. You do not have to have both parents be U.S. citizens. You can go to any U.S. embassy and report a birth and bam your child is a natural born citizen. And also, the U.S. technically doesn't recognize dual citizenship. So that wouldn't disqualify him at birth either.

I have read through these comments and I believe they prove that Obama is, indeed, a "natural born" citizen.

Understand, I did not vote for Obama, not because he is not a citizen but because he is a socialist and I fear for the policies he will implement. That being said I believe the simplest lock down of his eligability is provided by willeb when he states:

Now lets break that down to this specific individual and assume he was born in Kenya (because we all should agree that if he is born in Hawaii the argument is over):

Obama was born in Kenya (outside the US), His father was a Kenyan citizen (alien) and his mother is a US citizen and grew up in Kansas (citizen/5 years).

By the legal code stated, Obama is a natural born citizen and therefore eligible to server as president and/or vice president.

The thing that bothers me is the part about prior allegiances. It doesn't matter where he was born. His mother was a citizen so he is a natural born citizen by law. Being born with dual citizenship doesn't change this fact either. I was born with dual citizenship and am a natural born citizen. My children were born outside the U.S. They too have dual citizenry and are natural born citizens. However holding two passports means I have an allegiance to another country thus supposedly disqualifying me from ever running for President. Wasn't this the case for Obama? I have read that he still traveled with a non-u.s. passport as an adult. Shouln't this be considered a prior allegiance? If it is open to interpretaion then I believe the Supreme court should be involved to interpret this part of the Constitution.

But Obama is indeed a Natural born Citizen. Even if he was born on the Moon. It doesn't matter.

Currently, Title 8 of the U.S. Code fills in those gaps. Section 1401 defines the following as people who are "citizens of the United States at birth:"

Anyone born inside the United States
Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe
Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.
Anyone falling into these categories is considered natural-born, and is eligible to run for President or Vice President. These provisions allow the children of military families to be considered natural-born, for example.

The Certification of live birth is not the same as a Birth Certificate. Anybody can get a certification of live birth by presenting information. Birth certificates are done by the hospital and transmitted to the state. Birth announcements can be placed in the paper for a fee and the fee is not much. Unfortunately I have found words have more meaning than you might think. In this case why did he not release his actual birth certificate, college records, how did he finance college? Conspiracy? We know that Obama met with Hillary and spent an hour talking at Diane Fiensteins house in Washington. This time went unaccounted for by campaign staff. There are more questions than answers. The founding fathers placed this in the constitution for a good reason, but since we have been operating outside the constitution for 80 years or so I think it doesn't matter. Either way we are going to get screwed, hang on to your wallet.

It is very east to get a Hawaiian birth certificate. Forgery is easily obtainable for anyone with the lack of morals.
