Detainee Abuse Photos

The Obama Administration has made clear that it plans to take a legal dispute over the release of detainee abuse photographs to the U.S. Supreme Court if necessary.

In papers filed with the Second Circuit Court of Appeals on Thursday - yes, the same circuit that is home to Judge Sonia Sotomayor - the Justice Department made clear it wants to fight the decision to release detainee abuse photos as sought by the ACLU and others.

The legal briefs say that there are 21 photos specifically addressed by this case, but that there are also a "substantial number of additional images" that could also be obtained through Freedom of Information Act requests, like that of the ACLU.

Arguing against a public release of any photos were two very familiar names in the miltiary, Gen. David Petraeus, now the leader of Central Command, and Gen. Raymond Odierno, the man in charge of US military work in Iraq.

A photo release would "endanger the lives of U.S. Soldiers, Marines, Airmen, Sailors, civlians and contractors," presently serving in Iraq and Afghanistan, said Gen. Petraeus.

The pages of the legal brief are marked SECRET, with a line through that word.

So far in lower courts, the ACLU has won the day on the this legal fight, one reason why the White House decided to give up on the matter.

But after an outcry from both parties and a plea from top military officials, the President switched gears earlier this month on the issue.

Congress could still get involved on this as well. Lawmakers last week included - in a bill funding the wars in Iraq & Afghanistan - a provision that basically prevents the photos from being released in response to Freedom of Information Act request.

    bucketheaddad: what did you mean by this part of your comment "they all now want indemnity from international legal implications"? Did you actually mean "immunity" but couldn't figure out the word you actually needed? Get real - there was no torture, not when you consider what those terrorists have done to our citizens. Pouring water on your head is not torture. And as far as our leaders possibly being investigated by foreign courts, that's ridiculous. Our laws are based on our Constitution, not on international agreements (at least, they are until some of PrezBO's nominees get into federal judgeships and then try to interpret our laws in light of public opinion and international sentiment). Did you ever serve in the military, or are you a person who sat back while others served? I have deployed four times (this war) and my son served in Afghanistan twice. I have many friends serving throughout the Middle East, and I damn sure want them to have every advantage they can get. And as far as your comment about Dick and George buying and paying for General Petraeus and Company, you need to pull your head out and apologize to every military person you ever meet. You obviously have no concept of what it means to serve your country unselfishly.

    How about right before releasing these photos of ""abuse"" we play the numerous tapes of Americans being beheaded by masked goons with dull machetes and kitchen knives. Or the raping of our women soliders by the same thugs.......

    But wait, that would make what we did look like kids play.

    So we poured water on the heads and faces of Muslim terrorists...and we got valuable information that helped save American lives. That is just about the worse thing I have ever heard of. Water...on their faces...they think they're drowning but they're not....boo hoo. I feel real sorry for them. (Violin playing)

    First, let's stop using the term "abuse" in the phrase Detainee Photos. It's misleading and assumes we know what is actually in the photos.

    Second, the President is being disingenuous with this legal fight, because all he has to do is seal the photos as a matter of national security under an exemption provided by the FOIA and the case is closed. By not using the exemption, if the Administration loses the case and the photos are released the President can claim innocence that they "did everything we could to protect this photos." But, in fact they didn't if they lose in court and don't use the national security exemption in the FOIA.

    Sooooooooooooooooooooo, Dick & George obviously bought and paid for Gen Petraeus & Company, and they all now want indemnity from international legal implications (if not "indictment"), under the guise of CONCERN FOR THE SAFETY OF OUR MILITARY, ETC.

    "Mr. President Obama, help us wash the blood from our hands" . . .

    Keep Dancing America. . .the Piper can wait.

    Normally I'm all for the rays of sunshine (pun intended) revealing the good, the bad and the mediocre of government workings. But, on this one, I'm leaning more to Petraeus, where nothing good can come out of this immediately. Put them in a envelope marked "Open in 15 years" and let the historians figure it out then.
