Second Amendment Health
It's right there, starting on Page 5, with a section entitled, "PROTECTION OF SECOND AMENDMENT GUN RIGHTS."
"A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to--"(A) the presence or storage of a lawfully possessed firearm or ammunition in the residence or on the property of an individual; or "(B) the lawful use, possession, or storage of a firearm or ammunition by an individual."
As is the case with many provisions in these bills, I would love to know who came up this plan, and the need to have it in the extra amendment offered on Saturday.
The gun issue has been bubbling out there, with notices like this on the web site of Gun Owners of America:
"The Senate's 2,074-page health care bill doesn't mention guns, but some gun owners are worried certain provisions could eventually be used to discourage or even restrict gun ownership as part of a government effort to influence behavior as it broadens its control over the health care system."
This new provision would limit data collection on guns, and it specifically says that the ownership of guns cannot be used to influence the cost of your health insurance policy.
"A premium rate may not be increased, health insurance coverage may not be denied, and a discount, rebate, or reward offered for participation in a wellness program may not be reduced or withheld under any health benefit plan."
Like I said earlier, I wonder who wanted this in the bill?
What others are saying
- Thanks JamieWe need to see this for what it is, a backdoor to be able to tax those who have firearms - almost like a person who smokes pays higher premiums for health care. Why else would it be under a wellness and preventon cloak?
- this is pro-2nd ammendmentThis addendum appears to be a pro 2nd amendment clause. It was likely added by someone who is... anti-2nd amendment.
Why do I say this when the amendment to this bill is clearly pro gun owners' rights? Because this is an excuse for the dems to point fingers at people who are pro 2nd amendment who will vote no on this bill and say "THEY VOTED NO AGAINST THE 2ND AMENDMENT!" - Existing FirearmsMy guess is that is has something to do with "existing" firearms. I know lawyers. They'll use the technicalities of the language to the detriment of all.
- 2nd amendmentit's also somewhat scary how quiet the dems have been on gun control this go round, seems they would have something up their sleeve since it's been a democrat issue for years. thanks for the good work Jamie, Greg in Raleigh
- Good Reporting - and reporterI love JD's perspective and insight. A great asset to WSB. In a time when media seems bent on propaganda rather than reporting JD is, well, reporting. How refreshing.
- interesting....Great find Jamie....I too wonder what else is in the bill that prompted this amendment?
Its been too quiet on this issue...curious what the NRA has to say?
