GBI Probes Brutality
(WSB Radio) The GBI is investigating after a Hartwell man says he was beaten up by a police officer.
51-year-old Jimmy Lee Blackwell claims a Hartwell police officer arrived at a home in February to serve a warrant. He asked to see Blackwell's identification. Blackwell's daughter Jessica Maddox, tells WSB he was outside and couldn't provide one and that's when things became violent.
"They said he didn't obey what they was telling him to do. He said he didn't fight or resist arrest or anything, they just started jumping on him," said Maddox.
Hartwell Mayor Matt Beasley tells WSB he has heard a different version of the story.
"An altercation started when Corporal Bobby Mitchell asked for i.d. of Jimmy Lee Blackwell. Mr. Blackwell continuously struck Corporal Mitchell. Corporal Mitchell, abiding by policy and procedure, sprayed Mr. Blackwell with pepper spray and then used his baton," said Beasley.
When it was over, Mr. Blackwell lost his left eye and Corporal Mitchell had a concussion.
Maddox says the warrant wasn't even for her father, but for someone else. But, no matter what the circumstances, the situation got way out of hand.
"Even if he was fighting, you don't have to beat someone to that degree just to arrest him," said Maddox.
There have been a couple of community meetings and the family has hired an Atlanta attorney to file a 17-million-dollar lawsuit against several Hart County officials.
Mayor Beasley says the community has been fairly calm.
"We're nervous about it. There are a lot of good people, there are a lot of calm heads. The ministers of our community are taking an active role in trying to ask for patience until the GBI's report comes out. But, there are some people that are not wanting to wait for justice," said Beasley.
Blackwell, who was charged with felony obstruction of a law officer and terrorist threats, is out on $10,000 bond.
The GBI is expected to wrap up its investigation by the end of the week.
"My heartfelt sorrow goes out to the Blackwell family and my heartfelt sorrow goes out to that police officer. This will be certainly, a lifelong impact on both of these individuals and their families," said Beasley.

Officer Stan got in my face in a dark parking lot threatening me. Bully boy. After I tighten my jaw to restrain the cuss words I wanted to throw at him, he said I needed a ticket for bad attitude. I pulled out a woman's tactic and said I was trying not to cry. He backed out of my face immediately, blustered for a minute and left. If I had been a man I can imagine a different ending. I didn't bother to report this guy because when I went to Chief Reno to make a complaint on Officer Sharod for writing a false ticket, the chief refused to take down the complaint. He just rambled on other stuff until I gave up and left. I contacted the mayor twice about his officers, both times he walked away from me, refusing outright to even listen. If the underlying feeling in town was that the cops are good guys, then this incident would be handled as a once in a lifetime issue. Instead it's the last straw for many people who simply cry out for having honest competent officers. And a fair and impartial judicial system. Before I go , I tell you to check Ga's census bureau for criminal statistics for Hartwell. For the same year Chief Reno won traffic ticket king status from the governor for his officers writing the most traffic tickets for a town of Hartwell's size. (When I read this I realized why I recieved my false ticket)This same year personal and property crime more than doubled in Hartwell, while the population decreased. In comparison, population in Hart county increased while crime decreased in all three measured areas for the county. These facts are accessible to anyone going online. Chief Reno is not capable of doing the job we need him to do. He needs to go. My fear is he knows where so many bodies are buried( politically of course) that we will be stuck with him for years to come.
- Hartwell's failure.thetruth, Your reply was very informative. It also supports what I said in earlier posts. The Hartwell cop should have, according the use of force continuum, sprayed (or tazered if applicable) the perpetrator when the suspect began to resist. That is Police tactics 101.
Once the screwdriver came out then the escalation of force is authorized. He then should have had him at gun point. If an attempt to use the screw driver in a threatening manner was attempted, then the use of deadly force was appropriate. (this can occur in less than a second) At that point, the criminal history of the perpetrator is irrelevant. If he was a five year veteran being 6ft. and 155lbs, then he would have known all of this and adjusted to the situation accordingly. He may not be fit for duty due to improper application of his use of force.
My point on this, and other posts is to have citizens hold police to the appropriate standards because of the criminal stuff I have witnessed. Who else will police the police? government?
As far as my spelling, that is a minor issue as I was in a hurry. As far as the officers degree, irrelevant, as it does not give you common sense, the will to live, or experience. Oh, and I have a political science degree, a history degree, a minor in sociology, and am working on my business degree and thanks for asking. - to steveFirst the officer was not serving a warrant.He observed so called victim drunk walking in middle of street.well since public intoxication is against the law in hartwell the officer stop to tell Him to get out of middle of street.He asked the blackwell for his name and he told officer to go f--- himself. The officer then told Blackwell he was under arrest for public intox. He then began to resist arrest.He then pulled a screwdriver out of his pocket and struck officer in base of skull giving him a fracture.The officer then used his pepper spray while being hit 18 times before officer pulled his baton.As for me this is a 6ft.155lb.officer being attacked by a 6ft. 220lb. convicted murderer. Yes I said murderer.If you look up so called victims record.Ga.Dept.of Cor.He was arrest for murdering a man and beating his girlfriend half to death. He got out and stabbed another man.5 years later. he is still awaitng trail for robbery and theft by taking charges from 2007. Jimmy Blackwell is a violent person/murderer who in my opinion should not even be out of prison. As far as your statement about educaton.Maybe you should check your spelling in your comments.Also before you remark on an officers education.He is a 5 year officer and has a criminal justice and sociology degree.which is probably more education than you have
- Educated speechWell Old School Clayton County You sound as if your were educated in public schools and I bet you are at least 50-80 pounds overweight. You and both know that not all of the facts in this case are out. It would be interesting to see them.
You state that you bet minimum force was used. I cite the facts in this article against that. First, how do you get into an esculated incident from an ID chack? Why not wait for back-up at the first sign of trouble so no one gets hurt as cops with common sense do and not those with an "I'll just kick your rear and throw you in jail mentality."
Second, How does the man lose an eye in the process? If you can not effectively take someone into custody with out causing them to lose body parts in the process then you are NOT fit for duty.
Third, if you can't fight and win; yet become unconsious from the fight then you are NOT fit for duty.
I surmise the following from this article and my experience in law enforcement.
For whatever reason the officer asked for the victim's ID. What was the reason for the contact? Casual or investigatory? BIG DIFFERENCE!
The victim, for some reason, did not produce one and the officer got mad and his "kick-butt and take names later attitude came out." The officer took it upon himself to give the man a "Come to Jesus Sermon" and the officer, who was probably 50 to 80 pound overweight as has been my experience in law enforcement of fellow cops, got his rear end handed back to him.
Now, if the officer was in the right then I support him but I have a problem with: why this incident was esculated if it could have been handled with back-up officers; the victim losing an eye in the process unless it was a life and death struggle; and the fact that the officer ended up unconscious becoming a danger to himself and others by losing control of his weapon.
Why were no other force options exercised like pepper spray, taser, ASP?
He may have been in the bad end of the political stick in the department and his fellow officers left him alone. I have seen that done. Cowards!
I have seen rookie cops answer a minor call and esculate it into a full blown fight with the suspect, and his family, when it could have been handled calmly and resovled without arrest and people going to the emergency room to get body parts reattached. - Alleged 4th Amendment ViolationLet's see if Steve's pre-conceived notion regarding police use-of-force transcends into U.S. District Court with this case. I'll bet the officer utilized the minimum force necessary to effect an arrest - and Jimmy resisted. I'm sure Steve has many years of experience as a police officer from which to draw his conclusion of police using excessive force. No offense, Steve. You have your right to free speech - whether the speech is educated, or not.

- Yet another shining exampleHere is yet another fine example of police in Georgia taking their duties out through a beating upon the public.
Often cops take their duties out too far when exercising the law and abuse the citizens. This officer was probably young and at the first sign of difficulty with the "suspect" he commences to beat the guy about the head and neck. That good ole' "Lets get out there and kick us some butt and take some names". Good grief.
This is just another illustration of crooks chasing crooks with the protection of the law and using force to accomplish their goals.
